Petitioners along with 14 others have been named in the FIR alleging therein that on the date of occurrence i.e. 23.6.2012 when the informant was at his Darwaja , the accused persons came and started indiscriminate firing in which the son of the informant received injury. One person namely Bahadur Yadav also sustained injury. Subsequently, Bahadur Yadav succumbed to the injury. The F.I.R. was initially lodged under Section 307 IPC, later Section 302 IPC was added. In course of investigation, it has come that there was free fight between two groups one led by the informant and the other led by Makuni Yadav coaccused and others. It is submitted that there is land dispute between them. Referring to Annexure-3, it has been submitted that

injured (later deceased) namely Bahadur Yadav in his first information report has clearly stated that there was free fight between two parties in which indiscriminate firings was/were resorted by both the parties in which he sustained injury. Referring to Annexure-3, it has been submitted that co-accused similarly placed has been granted bail. He has further submitted that several other accuseds named in the FIR have been granted bail by this Court. Petitioners are in custody since 7.11.2012.

Considering the facts and circumstances of the case, the petitioners abovenamed are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1^st Additional District and Sessions Judge, Munger in connection with Sessions Case No. 117 of 2013 (arising out of Naya Ram Nagar (Safia Sarai) P.S. Case No. 81 of 2012) subject to the following conditions:

(i) One of the bailors shall be own/close relative of the petitioners. (ii) After the framing of charges, the petitioners shall appear in person regularly in Court. In case of default on such appearance for two
