The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 504 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that on the order of petitioner Pandav Yadav, Birendra Yadav caused injury with rifle to Chingi Yadav when petitioner Shambhu Yadav assaulted with lathi.
It is submitted by learned counsel for the petitioners that petitioner no. 1 is the younger brother of the informant when petitioners were not sent up for trial but differing with the same cognizance has been taken and the accusation has been levelled in the background

of serious land dispute.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saharsa in connection with Salkhua P.S. Case No. 94 of 2009, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
