4 03-10-2013 Heard learned counsel for the petitioner and learned
APP for the State.
Petitioner is in custody since 31.10.2012 in connection
with Maner P.S. Case No. 210 of 2012 instituted under diverse
sections of Penal Code including Section 307 IPC. The allegation
contained in the FIR is that a group of persons including four
named therein opened indiscriminate firing causing bullet injury to
the informant and some of the family members. The allegation is
that the group which opened indiscriminate firing had arrived for
the purpose of committing loot in the house of the informant. The
villagers assembled and pelted stones at the accuseds.
Learned counsel for the petitioner submits that
petitioner is co-villager. One of the accuseds named in the present
case namely Nagendra Singh had lodged a case earlier against the
informant. By the impugned order, the prayer of the bail on behalf

of Nagendra Singh was also considered and rejected. Aforesaid Nagendra Singh has since been released on bail by this Court by order dated 01.07.2013 passed in Cr. Misc. No. 14897 of 2013. The injury sustained by the informant and other injureds was subsequently made part of the case diary and on perusal whereof it would appear that they were simple bruises and abrasion. It is submitted that apart from the present case only one criminal case lodged against the petitioner under Arms Act is pending consideration in which he has been released on bail.

Considering the facts and circumstance of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Maner P.S. Case No. 210 of 2012 subject to the condition that one of the bailors shall be own/close relative of the petitioner.
