| The petitioner seeks bail in a case instituted under | |

On secret information the police raided a truck laden with onions standing near the village Saidpur on N.H.30. Three accused persons attempted to escape but they were apprehended. The FIR was accordingly lodged against those three persons. The name of the petitioner appears in course of investigation through the confessional statement of the accused persons cited in the FIR.
Learned counsel for the petitioner submits that except confessional statement of the co accuseds, there is no other incriminating material against him. He is in jail custody since 14.01.2013.
Learned APP, on the other hand, submitted that there is no criminal antecedent of the petitioner.

In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Barh in connection with Bakhtiyarpur P.S. Case No. 264/12 subject to the conditions that one of the bailors shall be his own/close family member and the petitioner shall appear in person on each date fixed at the trial. In case of default in such appearance on two consecutive dates the trial court shall cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
