4 08-10-2013 Heard Mr. Yadav for the petitioner and Mr. Uma
Shankar Prasad Singh, learned APP for the State.
Petitioner seeks bail in a case instituted under diverse
Sections of the Penal Code including Section 307 of the IPC.
As per the prosecution case, on a trivial issue the
petitioner is said to have inflicted ‘Dabia’ blow on the occipital
region of the informant. The informant sustained grievous injury.
Learned counsel submits that the petitioner is in
incarceration since 6.2.13. From bare perusalf of the FIR it would
appear that the cause of incident was grazing of wheat field of
the petitioner by the she goat of the informant.
Learned APP for the State, on the other hand,
submits that the petitioner carries criminal antecedent.
Petitioner has filed a supplementary affidavit

explaining the status of those cases. It has been stated that at least three in those cases petitioner has already been acquitted by the Court below. In the remaining cases of minor nature, the petitioner is privileged with bail.

In the facts and circumstances of the case, this Court is persuaded to enlarge the petitioner on bail. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each

to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Nauhatta P.S. Case No. 1 of 2013, subject to the following conditions:-

One of the bailors shall be the own/close family member of the petitioner.

Once the charges are framed in the trial, the petitioner shall appear in person before the trial Court on each date. In case of default in such appearance on two consecutive dates the trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance
