JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 06-05-2013 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 379, 427 of the I.P.C. and 3(i)(x) of the SC & ST (Prevention of Atrocities) Act. Accusations are of demolishing the house of the informant, taking away Rs. 75,000/- and other articles and abusing by calling caste name.

It is submitted by learned counsel for the petitioners that for the initial occurrence of 28.11.2012 the First Information Report was lodged on 02.12.2012 when

subsequently the case was lodged by the petitioners’ side also for the same occurrence against the informant. It is further submitted that informant has subsequently retracted from the initial version.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar(SC & ST) P.S. Case No. 12 of 2012, subject to the conditions as laid down under Sections 438(2) of the Cr. PC
