Informant a police official on getting confidential information conducted raid at the house of father of the petitioner and seized one motorcycle alleged to be stolen as well as pamphlets relating to naxali organization.

It has been contended on behalf of petitioner that though he happens to be separate in mess and business from his father and resides at U.P. where he is employed in a factory, cannot be clubbed along with his brother and father for the recovery of motorcycle as well as pamphlets. In worst case, it happens to be a case of joint possession. Also submitted that petitioner though carries criminal antecedent but happens to be under custody since 16.01.2013 as well as 24.12.2012 respectively.

Prosecutor opposed the prayer and submitted that petitioners including his father were / are actively indulged in anti-social activity.

Taking into account the allegation on its face, petitioners (1) Mithlesh Yadav and (2) Yugal Kishore Prasad @ Yugal Kishroe Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Sherghati in connection with Raushanganj P.S. Case No.55 of 2010, subject to condition that till conclusion of instant trial both the petitioners will give their physical presence at the Raushanganj Police Station once in a month and will submit report before the court concerned regarding compliance of the condition imposed. In case, there happens to be non-compliance on the part of the petitioners, then in that event, the learned lower court will be at liberty to cancel the bail bond.
