2 03-04-2013 Heard learned counsel for the petitioner as well as learned Additional P.P. On account of recovery of the iron rod along with other items from the house of Dhiraj Chouhan for which he named one Bindeshwari Singh, as an accomplice a case punishable under Section 414 of the Indian Penal Code has been registered. It has been contended that nothing has been recovered from possession of the petitioner nor his name stood in the statement of the informant, a police officer. During the course of investigation, he has been apprehended as a co-accused on the basis of extra judicial confessional statement of Dhiraj Chouhan. It is also submitted that Dhiraj Chouhan stood enlarged on bail vide Cr. Misc. No. 22284 of 2012 while Bindeshwari singh enlarged on bail vide Cr. Misc. No. 23681/2012.

It is further submitted that he happens to be under custody since 9.1.2013.
The learned Additional P.P. opposes the prayer and submitted that from the manner of occurrence it is evident that in a pre-planed manner the offence was being committed wherein articles illegally obtained and kept concealed.
In the aforesaid facts and circumstances of the case, petitioner Radha Krishna Chouhan @ Govind is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S.Case No. 65/2012.
