The petitioners are apprehending their arrest in a complaint case in which cognizance has been taken for the offence punishable under Section 406 of the Indian Penal Code.
It is alleged in the complaint that Rs.2.00,000/- was given to Lalit Lal, petitioner no. 1 for making investment in Reliance Life Insurance for getting three times of the invested money in six years but only receipt of Rs.30,000/- was given and Rs.1,70,000/- was misappropriated.
It is submitted by learned counsel for the petitioners that there is no proof with regard to the payment when in the complaint it is said that the money

was given to Lalit when in the S.A. it is said that the
money was given to Anil Kumar.
It is submitted by learned counsel for the complainant that petitioners are brothers and both have jointly misappropriated the money of the complainant but denied that there is no proof with regard to the payment.
A statement has been made in para 18 that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Complaint Case No. 1694 of 2009, Tr. No. 1298 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
