JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 26-04-2013 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the I.P.C. Accusation is of assaulting the informant with farsa and subsequently killing him by strangulation.
It is submitted by learned counsel for the petitioners that postmortem reflects no external injury when accusation was found false and final form was submitted and petitioners were not sent up for trial, but differing with the final form, cognizance has been taken.
A statement has been made in para 17 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or

surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 17 of 2012, G.R. No. 414 of 2012, subject to the conditions as laid down under Sections 438(2) of the Cr. PC.
