A counter affidavit and a supplementary counter affidavit is on record. It is pointed out that consequent to the dismissal of the S.L.P. filed by the State by the Apex Court the petitioners and their like have been reinstated as stated in paragraph-5 of the supplementary counter affidavit sworn by the Executive Engineer, Irrigation Division, Saharsa all the dues, i.e., full salary from the time of dismissal up to date has been paid to the petitioner on

19.06.2007. In view of the said averment, the writ petition has become infructuous.
Accordingly, the writ petition is dismissed as infructuous.
