It appears that petitioner was initially appointed as Ring Khlasi and was promoted as Ring Assistant on 01.01.1978 in the Mechanical Circle of P.H.E.D., Government of Bihar. Thereafter, he was made the Ring man. Considering his merit and seniority and his ability to work independently by order of the Chief Engineer (Mechanical), as contained in Memo No.611 dated 28.05.1985, he was promoted to the post of Assistant Driller and posted on vacant post available in the Division. This is Annexure1 to the writ application. Thereafter, the petitioner was paid his emoluments as per the said post for sometime. Along with the petitioner several other persons including one Chandeshwar Ram and Md. Ahsan were also promoted under similar circumstances. It appears that all of a sudden their remunerations were stopped. They all approached this Court. This Court in C.W.J.C. No.9123 of 1995 disposed of on 16.01.1997 directed the authorities to reconsider the matter. It appears that upon reconsideration of the matter the Engineer-in-Chief-cum-Special Secretary vide order dated 27.09.1997 directed that payment has been made earlier to the petitioner and their like would continue and all arrears and payment should be cleared. Following this, directions were issued to the Superintending Engineer by the Divisional Chief Engineer. It appears that again the matter was reopened by the Department which forced to Md. Ahsan to come to this Court. While the matter was pending, the Chief Engineer (Civil) took a decision, as contained in Annexure-8 to the writ application and Annexure-B to the counter affidavit
