Legislative Assembly, which is Annexure-1 to the writ petition. It has been published in various newspapers on various dates in the middle of January, 2001. It calls for application to fill up the vacant posts of Khalasi, Peon, Orderly Peon and some other categories. The first thing to be noticed is this advertisement does not stipulate the number of vacancies and the nature of posts whether permanent or temporary as would be necessary in view of Rule-3(i) of the Rule aforesaid but it only refers to vacant posts on the pay scale given therein. As apparently, all the posts are Class-IV posts, the petitioners, accordingly, applied. It took the Secretariat of the Assembly over a year to process the applications and, ultimately, in January, 2003 on various dates tests were held for which admit cards were issued to the petitioners, which are Annexure-2 series to the writ petition. Thereafter, it appears that in the year 2003 itself a panel was prepared for appointment. The first lot of appointments was made for certain number of posts and marking the appointments to be temporary. This was in the year 2003 itself. It was not said that further appointments were in the process. In course of time further vacancies arose. Apparently, the Speaker extended the life of the panel to February, 2005 and accordingly 2nd lot of appointments was made from this panel and this time appointments were made for a fixed term. These appointments were made in the year 2004. It appears that subsequently so far as this seond lot of appointments was concerned, they were then made into contractual fixed period appointments. Petitioners had not figured in either of these two sets for appointments.
