3 06-09-2012 Heard learned counsel for the petitioner and the State.

Petitioner is aggrieved by the threat extended by the officers of the Kishanganj Municipal Council to demolish front portion of her house, as according to the authorities the road abutting her house is required to be widened and for such widening of road frontage of her house is to be demolished. It is submitted on behalf of the petitioner that she having not made any encroachment over the road lands, without acquiring the land over which the front portion of her house is raised, the same cannot be demolished.

Let the petitioner appear before the Executive Officer, Kishanganj Municipal Council and produce a copy of this

order before him whereafter the Executive Officer shall depute his Amin to measure the width of the road with reference to the land acquisition, municipal records and in the light of the measurement report pass appropriate order in the matter. In the event Executive Officer is satisfied that there is encroachment made by the petitioner, he shall indicate such fact by passing a speaking order within reasonable time not exceeding two months from the date of receipt/production of a copy of this order before him.

The writ application is, accordingly, disposed of.
