Earlier prayer for bail of the petitioner was rejected by this court vide order dated 09-12-2011 passed in Cr. Misc. No. 34831 of 2012 with liberty to the petitioner to renew his prayer for bail after completion of nine months in jail custody but before completion of nine months in jail custody, again, Cr. Misc. No. 13753 of 2012 was filed and the petitioner was granted privilege of bail by this court to get his ailing wife treated with direction to him to surrender before the learned Chief Judicial Magistrate, Araria after completion of two months from the date of release and in compliance of the aforesaid order, on 18-06-2012, the petitioner surrendered before the court below and since then, he is languishing in jail

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner, namely, Md. Kamruzzama be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 272 of 2012 arising out of Jockihat P.S. Case No. 28 of 2011 to the satisfaction of Additional Sessions Judge (F.T.C. No.-I ), Araria.
