This is a petition for grant of regular bail for offence under Section 395 of the Penal Code.
The first information report is against unknown. However, the only material against the petitioner is the confessional statement of the co-accused.
The learned counsel for the petitioner submits that neither any recovery has been made from the possession of the petitioner nor the petitioner has been put on test identification parade. The petitioner is in jail since 27.03.2012 having no criminal antecedent.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 353 of 2010 arising out of Rafiganj P.S. Case No. 7 of 2009 to the satisfaction of the Additional District Judge, II, Aurangabad.
