State.
This is a petition for grant of regular bail for offence
under Sections 147, 148, 149, 379, 436, 427 and 120B of the Penal
Code, 27 of the Arms Act and 17 of the Criminal Law
Amendment Act.
The learned counsel for the petitioners submits that
the petitioners have not been named in the first information report.
However, the name of the petitioners finds place in the
supplementary case diary, as apparent from the order of the
Session's Judge. It was submitted that the petitioners are not the
members of the extremists group and the name of the petitioners
finds place in the supplementary case diary after some time.
Hence, having regard to the facts and circumstances
of the case, the petitioners, above named, are directed to be
released on bail on furnishing bail bonds of Rs.10,000/- (rupees
ten thousand) each with two sureties of the like amount each in
connection with Chutiya P.S. Case No. 10 of 2011 to the
satisfaction of the Sub Divisional Judicial Magistrate, Dehri
Rohtas, subject to the condition that one of the bailors of each of
the petitioners shall be close relative, the petitioners shall not
indulge in such activity further and if he indulges, then, the
deponent must inform the Court about the indulgence of the
petitioner(s) and the Court below, itself, shall, proceed to cancel
the bail bond of the petitioner(s) and the petitioners shall appear in
