JUSTICE DINESH KUMAR SINGH ORAL ORDER 4 01-11-2012 Petitioner is apprehending his arrest in a complaint case in which cognizance has been taken under Sections 420, 406, 467, 468/34 of the I.P.C. Petitioner is one of the Directors of M/S Amazing Fabrics Retail India Limited. Petitioner along with others entered into an agreement with the complainant for opening a showroom for which the complainant deposited Rs. 5,00,000/- as security money and Rs. 3,00,000/- was spent on the construction of the showroom when Rs. 50,000/commission was to be paid per month. The F.I.R. was lodged against four persons and petitioner was one of them.
Petitioner undertakes to deposit a draft of Rs. 1,25,000/- within a period of six weeks before learned Court below which will be released in favour of the complainant. After receipt of the aforesaid draft the complainant will have no claim

On deposit of the aforesaid drafts, let the petitioner namely Raghvendra Kumar, in the event of his arrest or surrender before learned Court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Samastipur(T) P.S. Case No. 269 of 2010.
