The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364/34 and 201 of the Indian Penal Code.

It is alleged that the brother of the informant was kidnapped and subsequently his dead body was disposed of when the FIR was lodged against Amit, Rajiv and Ganga Sagar. The petitioner was not named in the FIR. Subsequently, suspicion was raised against the petitioner also that he was also participated in the occurrence.

It is submitted by learned counsel for the petitioner that the petitioner was not named in the FIR for the occurrence of 28.11.2008 when the informant in 2009 after five months of the occurrence raised suspicion

against the petitioner when suspicion was also raised by one Megha Singh against the petitioner.

A statement has been made in para 11 that the petitioner has no criminal antecedent.

Considering the fact that the suspicion was raised after five months of the occurrence, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IX, Patna in connection with Sessions Trial No. 1222 of 2010 arising out of Phulwarisharif P.S. Case No. 498 of 2008, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The trial court will be at liberty to cancel the bail of the petitioner if he defaults for three consecutive occasions.
