2 19-10-2012 Heard learned counsels for the petitioner and the State.
The petitioner no.1 being the brother-in-law (Dewar)
and petitioner nos. 2 to 4 being the agnates of the complainant are
apprehending arrest in a case registered for the offences
punishable under Sections 498A and 379 of the Indian Penal Code
and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
Due to intercaste marriage being performed by the
complainant with the brother of petitioner no.1, the in-laws family
members were annoyed when the complainant was abused by
calling caste name and assaulted when petitioner no.1 took out the
silver jwellary from the neck of the complainant.
It is submitted by learned counsel for the petitioners that
since the brother of the petitioner no.1 performed love marriage
with the complainant hence in that background, the accusation has
been levelled when the occurrence has not taken place in public

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sitamarhi Sadar in connection with Complaint Case No. C-1/7 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
