The writ petition has been filed with the following prayer:-

“It is therefore, prayed before your Lordships, may be graciously be pleased to issue a Rule Nisi calling upon the Opposite Parties to Show Cause as to why appropriate directions shall not be issued to the Opposite Party No.-3 to restore the lease land and issue ROR in the name of the present Petitioner Record of Right appertaining to Khata No.-389/5, Plot No.-256/1953 Ar. Ac. 0.850 dec. in Mouza - Mundamba, Tahasil / Khordha within a short and stipulated period of time;

AND to grant may other relief as deemed fit and proper in the circumstances of the case;

AND for said act of your kindness, the Petitioner as in duty bound shall ever pray with any terms and conditions as deem fit and proper.’

In course of hearing, Mr.Pattanayak, learned counsel for the Petitioner submits that the lease hold property was resumed vide order dated 20^th December, 2001 in Resumption Case No.117 of

It is his submission that the said order is not under challenge in this writ application. However, he prays for withdrawal of this writ petition to avail remedy under Section 7 of the Orissa Government Land Settlement Ac, 1962 (for brevity, ‘the Act’) by filing an Appeal against the order passed under Section 3-B of the Act in Resumption Case No.117 of 2001.

In view of the above, the writ petition stands disposed of as withdrawn with an observation that the Petitioner, if so advised, may file an Appeal under section 7 of the OGLS Act along with an application for condonation of delay.
