This writ application has been filed with the following prayer:

“The petitioners, therefore, pray that this Hon'ble court may graciously be pleased to issue Rule NISI to the Opp. Parties, calling upon them to show cause as to why the writ application filed by the petitioner shall not be allowed and if the Opp. Parties fail to show cause or insufficient cause, the said Rule may be made absolute directing the Opp. Party No. 2 to refer the L.A. Case No. 20 of 2020 of the petitioner to the Competent Authority-Opp. Party No. 3 for proper adjudication.

And/or pass any other order/orders as deem(s) fit and proper in the interest of justice.”

Mr. Samir Kumar Mishra, learned Senior Advocate appearing for the petitioner submits that there are some fundamental defects in the writ petition. Hence, he submits that interest of justice will be best served, if liberty is given to the petitioner to withdraw the writ petition and to file a fresh one with better particulars.

Mr. S.N. Biswal, learned Additional Standing Counsel does not have any objection to the same.
