2. Heard learned Counsel for the Petitioner so also learned State Counsel, who accepts notice on behalf of the Opposite Parties and admits to have received copy of the writ petition with I.A.

3. Though the matter is listed under the heading “Fresh Admission”, in view of the limited grievance of the Petitioner, on consent of the parties, the writ petition is taken up for admission and final disposal at the stage of admission.

4. The Petitioner, which is a Women Self Help Group (WSHG), is before this Court apprehending that it may not be permitted to participate in the selection process

as a WSHG for procurement of paddy for Kharif 202425, in terms of advertisement No.3551 dated 30.11.2024, as at Annexure-12 even though it is a disciplined WSHG and there is no allegation against it. Rather it has been awarded for its satisfactory performance with certificate by the Collector & D.M., Bhadrak in recognisition of its outstanding effort for completion of verification of suspected plots under Odisha Paddy Land Survey (OLPS) for the KMS: 202223

The further grievance of the Petitioner WSHG is that, being aggrieved by the inaction of the Authority concerned to consider the case of the Petitioner, it approached this Court vide W.P.(C) No.27471 of 2024, which stood disposed of at the stage of admission giving liberty to the Petitioner-SHG to approach the Collector, Bhadrak for appropriate relief.

6. Paragraph Nos.2 & 3 of the said order dated 18.11.2024, passed in W.P.(C) No.27471 of 2024, being relevant, are extracted below:-

“2. In the course of hearing of the writ petition, Mr. Santosh Kumar Mahanty, learned counsel for the Petitioner seeks leave of the Court to withdraw the present writ petition by praying to grant liberty to the Petitioner to approach the Collector, Bhadrak for appropriate relief.

In view of the above, the present writ petition stands disposed of as withdrawn with aforesaid liberty as prayed for”.

7. Learned Counsel for the Petitioner submits, pursuant to the said liberty granted by this Court, though the Petitioner gave a representation to the Collector, Bhadrak on 21.11.2024, the same is still pending for consideration.

8. In view of the above, the writ petition stands disposed of directing the Opposite Party No.4 i.e. District Social Welfare Officer, Bhadrak to allow the Petitioner-SHG to participate in the said process as per the advertisement dated 30.11.2024 and consider it’s case in terms of the guidelines.

It is made further clear that while considering the application of the Petitioner, due weightage should be given to its past experience and satisfactory performance, as has been demonstrated before this Court by producing the certificate of appreciation issued by Collector & D.M., Bhadrak dated 01.12.2022.

10. With the above observation and direction, the writ petition stands disposed of.

11. Urgent certified copy of this order be issued in course of the day.

In view of the urgency shown by the learned Counsel for the Petitioner, in addition to the certified copy, Petitioner is permitted to utilize the digitally signed copy of this order available in the website of this Court for the purpose of communication of this order to the District Social Welfare Officer, Bhadrak (O.P.
