The petitioner wife seeks transfer of C.P. No. 15 of 2022 from the Court of learned Civil Judge, (Senior Div.), Athagarh to learned Family Judge Court, Cuttack.

Prayer for transfer has been made on the ground that the petitioner is a distressed lady having no source of income. As such, it would be difficult on her part to travel to Athagarh to attend to the case.

Considering the submissions and the relative inconvenience that may be caused to the parties if the proceeding is allowed to continue at Athagarh, this Court is of the view that it would cause more inconvenience to the petitioner wife than the opposite party husband.

It is directed that the proceedings in C.P. No. 15 of 2022 be transferred from the Court of learned Civil Judge, (Senior Div.),

Athagarh to learned Family Judge Court, Cuttack.

It shall be open to the Opposite Party-husband to seek necessary permission for appearing through virtual mode. Further, the Court below shall not insist upon personal attendance of the parties unless absolutely necessary.
