Learned counsel for the petitioner is permitted to correct the typographical error in the cause title in Court.

The petitioner wife seeks transfer of C.P. No. 587 of 2023 from the Court of learned Judge, Family Court, Bhubaneswar to the Court of learned Judge, Family Court, Kendrapara.

Prayer for transfer has been made on the ground that the petitioner is a distressed lady having no source of income. As such, it would be difficult on her part to travel to Bhubaneswar to attend to the case.

Considering the submissions and the relative inconvenience that may be caused to the parties if the proceeding is allowed to continue at Bhubaneswar, this Court is of the view that it would cause more inconvenience to the petitioner wife than the opposite party husband.

It is directed that the proceedings in CP No. 587 of 2023 be transferred from the Court of learned Judge, Family Court,

Bhubaneswar to the Court of learned Judge, Family Court, Kendrapara.

It shall be open to the Opposite Party-husband to seek necessary permission for appearing through virtual mode. Further, the Court below shall not insist upon personal attendance of the parties unless absolutely necessary.

Further, the learned Judge, Family Court, Kendrapara shall try and dispose of the case expeditiously as possible preferably within six months.

Resultantly, the transfer application is allowed.
