1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State. Perused the writ petition as well as documents annexed thereto.

The present writ petition has been filed by the petitioner with the following prayers:

“The petitioner therefore, humbly prays that this Hon’ble Court may graciously be pleased to admit the writ application, issue Rule NISI calling upon the opposite parties to show cause as to why the representation under annexure-3 shall not be considered by the opposite parties within a stipulated period and as to why the petitioner’s representation to regularize the gap/waiting period for make payment of salary from 01.11.2018 to 28.04.2020 shall not be regularized by the opposite parties, if the opposite parties failed to show cause or shown insufficient cause the rule may be made

absolute against the Opposite Parties.

May pass any other appropriate direction(s)/order(s) as this Hon’ble Court consider may deem just and proper.”

It is submitted by learned counsel for the petitioner that although the petitioner has filed representation dated 06.01.2023 under Annexure-3 before the Chief District Medical & Public Officer, Koraput-Opposite Party No.5 the same is still pending before the said Opposite party and the said Opposite Party have not taken any decision as of now.

Considering the submissions made, the limited nature of grievance of the petitioner, this Court disposes of the writ petition at the stage of admission with a direction to the Chief District Medical & Public Officer, Koraput-Opposite Party No.5 to consider the representation of the petitioner dated 06.01.2023 under Annexure-3 in accordance with law within a period of two months from the date of production of certified copy of this order. It is needless to mention here that the representation of the petitioner shall be considered and disposed of by passing a speaking and reasoned order. Any decision so taken on the said representation shall be communicated to the petitioner within a period of two weeks thereafter.

With the aforesaid observation/direction, the writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
