This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel.

The Petitioner has filed the present writ application with the following prayer:

“ It is therefore, prayed that the Hon’ble Court may graciously be pleased to issue notice to the Opp.Party and after perusal of causes shown, be further pleased toset aside the order of suspension of P.D.S. licence of the Petitioner dated 09.06.2015 as illegal and further the P.D.S. quota of the Petitioner may be restored as before;

And pass such other order/direction as may be deemed fit and proper in the interest of justice’:

In course of hearing, learned counsel for the Petitioner submits that the Petitioner may be granted liberty to file a fresh representation ventilating his grievance before the Sub-Collector, Sadar, Cuttack, sole Opposite Party which may be considered within a stipulated period of time in accordance with law.

Learned Additional Standing Counsel for the State on the other hand submits that he has no objection if liberty is granted to the

Petitioner to file a fresh representation before the sole Opposite Party and the same is considered and disposed of in accordance with law.

Considering the limited nature of prayer, this Court deems it proper to dispose of the Writ Petition by giving liberty to the Petitioner to approach opposite Party no.1 by filing a fresh representation taking therein all the grounds in support of his prayer for restoration of P.D.S. quota along with supporting documents within a period of two weeks from today. In the event such representation is filed the sole Opposite party shall do well to consider the representation of the Petitioner in accordance with law and dispose of the representation of the Petitioner within a period of six weeks from the date of filing representation. The decision so taken be communicated to the petitioner within two weeks thereafter.

With the aforesaid observation, the writ application stands disposed of.
