It is agreed by learned counsel for the parties that the issue involved in this writ petition is analogous to one involved in W.P.(C) No. 12789 of 2004, which has been allowed vide judgment passed today (02.01.2023).

Therefore, in view of the reasons stated in the judgment dated 02.01.2023 passed in W.P.(C) No. 12789 of 2004, this writ petition stands allowed in terms of the said judgment.
