Heard Mr. N. Lenka, learned counsel for the petitioner and Mr. A.K. Sharma, learned Addl. Government Advocate for the State opposite parties.
The petitioner has filed this writ petition seeking to quash order dated 09.11.2020 passed by the Tahasildar, Khuntaopposite party no.4 in Tauzi Misc. Case No.03 of 2017 holding that the petitioner is liable to pay Rs.9,30,440.00.
Mr. A.K. Sharma, learned Addl. Government Advocate appearing for the State opposite parties raised a preliminary objection with regard to maintainability of the writ petition, in view of availability of alternative remedy by way of appeal.
In view of such submission, this Court is not inclined to entertain the writ petition. However, liberty is granted to the petitioner to pursue his remedy by filing appeal before the appropriate forum.
With that liberty, the writ petition stands disposed of.
The certified copy of the order at Annexure-10 be returned to the petitioner by substituting authenticated xerox copy thereof.
As COVID-19 pandemic situation is continuing, learned counsel for the parties may utilize the soft copy of this order available in the High Court’s official website or print out thereof at par with certified copies in the manner prescribed vide Court’s Notice No.4587 dated 25.03.2020.
