Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.344 of 2019 arising out of Bolangir Town P.S. Case No.162 of 2019 pending in the Court of learned S.D.J.M., Bolangir for offences punishable under sections 341/307/324/326/294 of the Indian Penal Code and section 25 of the Arms Act.

The petitioner moved an application for bail before the Court of learned Sessions Judge, Bolangir which was rejected on 14.08.2019.

Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 04.04.2019 and charge sheet has been submitted under sections 341/307/324/326/294 of the Indian Penal Code and section 25 of the Arms Act and in view of the period of detention of the petitioner in judicial custody, the bail application may be favourably considered.

Mr. Jyoti Prakash Patra, learned counsel appearing for the State on the other hand submitted that the injured in this case is one Alok Ranjan Das and he stated that due to the sword blow given by the

petitioner, the wrist portion has been separated from the hand and there are eye witnesses to the occurrence.

In view of the materials available on record, the nature and gravity of the accusation and the nature of injury caused, I am not inclined to release the petitioner on bail.

Accordingly, the BLAPL stands rejected.

¶12

However, the petitioner may renew the prayer for bail after examination of the injured and other eye witnesses to the occurrence in the trial Court.

The BLAPL is accordingly disposed of.
