Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Sessions Case No.8/17 of 2015 arising out of Sonepur P.S. Case No.116 of 2014 pending in the Court of learned Addl. Sessions Judge, Sonepur for offences punishable under sections 302/201/34 of the Indian Penal Code read with sections 25/27 of the Arms Act.

The petitioner moved an application for bail before the Court of learned Addl. Sessions Judge, Sonepur which was rejected on 03.07.2019.

Perused the report of the learned Addl. Sessions Judge, Sonepur dated 21.09.2020 in which it is mentioned that on 17.03.2020 charge was framed against the petitioner and other co-accused but not a single witness has been examined so far. The petitioner is in judicial custody since 23.09.2014. In view of the period of detention of the petitioner in judicial custody and since not a single witness has been examined, I am inclined to release the petitioner on interim bail for a period of three months from the date of release and the petitioner shall surrender before the learned trial Court

immediately on the expiry of said period.

For the above period, let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000/-(rupees fifty thousand) with two local solvent local sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court may deem just and proper and with further conditions that the petitioner shall not try to come in contract with any of the prosecution witnesses and appear before the learned trial Court on each date when the case would be posted for trial.

Violation of any terms and conditions shall entail cancellation of bail.

The BLAPL is accordingly disposed of. Issue urgent certified copy as per Rules.
