2 8.5.2020 Heard learned counsel for the petitioner and learned counsel for the State.
This is an application for bail under Section 439, Cr.P.C. The petitioner has been implicated for the offence under Sections 20(b)(ii)(c)/29 of NDPS Act and is in jail custody in connection with T.R.Case No.22/2018 pending in the Court of Additional Sessions Judge-cum-Special Judge, Koraput.
Perused the case history narrated in the Bail Application. For the nature of material seized and the offence committed involve a crime to the society and for the observations in the rejection order impugned herein, this Court finds, there is prima facie material trying the petitioner. Therefore, this Court is not inclined to release the petitioner on bail.
The BLAPL thus stands rejected.
