This is the second journey of the petitioner, who is in custody in connection with Golanthara P.S. Case No.145 of 2019 corresponding to G.R. Case No.798 of 2019 pending in the court of the learned S.D.J.M., Berhampur running for the alleged commission of offence under sections 332/307/294/506/34, I.P.C. read with section 25(1-B)(a)/27 of the Arms Act and 3/5 of the E.S. act has filed this application under section 439, Cr.P.C. for his release on bail.
Heard learned counsel for the petitioner and learned counsel for the State.
Learned counsel for the petitioner prays for withdrawal of this application with liberty to move the court in seisin of the case citing all such developments, which have taken place in the meantime including the factum of release of co-accused Sankar Rout on bail.
Granting the liberty aforesaid, the BLAPL is disposed of as withdrawn.
