The petitioner, namely, Hrusikesh @ Anil @ Bapuni Rout is implicated in Madhupatna P.S. Case No.104 of 2019, corresponding to G.R. Case No.1224 of 2019 of the Court of learned J.M.F.C.(CTY), Cuttack for the offence U/s.394/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that in this case the co-accused Ranjan Mallick, who stands on equal footing with that of the present petitioner, has already been released on bail vide order dtd.20.11.2019 passed in BLAPL No.8124 of 2019. The present petitioner is in custody since 9.08.2019.
Having regards to the nature of accusation, period of detention and following the principle of parity, I am inclined to grant bail to the present petitioner. Hence ordered.
Let the petitioner Hrusikesh @ Anil @ Bapuni Rout be released on bail by the learned court in seisin over the matter in the above noted case, on such terms and conditions as deemed just and proper.
The BLAPL is accordingly disposed of.
