This Crl. Misc. Application has been filed for restoration of BLAPL No.2915 of 2018 which has been dismissed for non-prosecution vide order dtd.01.02.2019 on the ground that non-appearance of learned counsel for the petitioner on that date was not deliberate or intentional but the same was due to certain unavoidable circumstances.
Learned counsel for the petitioner submits that unless the case is restored, the petitioner shall be highly prejudiced and suffer irreparable loss.
Having regards to the reasons stated in the application, the same is allowed. The BLAPL No.2915 of 2018 is restored to its original file.
The CRLMA is accordingly disposed of.
