By way of this writ petition, the petitionersCompany has prayed for a direction to opposite party nos.1 and 3 to 5 to release all the admitted dues of the petitioner pending with them and also return the E.M.D. amount deposited by the petitioners within a stipulated period.
Perused the counter affidavit filed on behalf of opposite party nos.1,2 and 5 in detail. In view of paragraph-9 of the said counter affidavit, it appears that the grievance of the petitioners is met with. For ready reference, the said paragraph-9 is reproduced hereunder:
“ 9. That the Firm further submitted another Bill dtd.25.2.2009 amounting Rs.78,596/- for payment of printing of 3 copies of draft photo Electoral Roll 2008, for 5 ACs of Bhubaneswar sub-division (copy enclosed in Annexure-3). Copy of letter dtd.25.02.2009 along with the Bill dtd.25.02.2009 is enclosed herewith and marked as Annexure-D/5 for kind perusal of the Hon’ble Court. This Bill is pending due to want of allotment of funds. Collector, Khordha, i.e., O.P. No.5 vide this office letter No.245/7.3.2009 has requested the Deputy CEO-cum-Deputy Secretary to Govt., Home (Elections) Deptt. for placement of funds in favour of Computer Aid (P) Ltd. The Govt. has been further requested vide office letter No.5882/Elec Dtd. 23.7.2019 for placement of funds for necessary payment.
The payment of the aforementioned pending Bill will be made after receipt of allotment from the Govt. in Home (Elections) Deptt. ”
In that view of the matter, the writ petition stands
disposed of.
