Case brief
What is this about?
The Court dismissed a writ appeal as infructuous due to a delay of twelve years and lack of activity by the appellant for over five years, with liberty to revive if difficulty is faced.
What did the court decide?
Appeal dismissed; liberty granted to file application for revival within thirty days.
What the court decided
W.A. No.84 of 2007
- 01.10.2019
None appears for the appellant.
By way of this appeal, the appellant has challenged the order dated 17.09.2007 passed by the learned Single Judge in W.P.(C) No.11838 of 2006 whereby the writ petition filed by the present appellant seeking a direction to the opposite parties therein to pay his balance dues as per the VRS/VSS Scheme for the period from 01.07.1990 to 31.12.1998, was dismissed.
It appears that this appeal was filed in the year 2007 and in the meantime about twelve years have elapsed. Further, after 15.10.2007, no step is taken by the learned counsel for the appellant at any point of time to get the matter listed. Further, it seems that by efflux of time, this appeal has become infructuous.
In view of the above, this appeal stands dismissed. Misc. Case(s)/I.A(s). connected to the appeal, if any, is/are dismissed accordingly.
It is made clear that the appellant will be at liberty to file an application within thirty days from today for revival of this appeal in case of any difficulty.
