13.05.2019 Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. for grant of bail to the petitioner in connection with Jeypore Sadar P.S. Case No.06 of 2019 corresponding to G.R. Case No.21 of 2019 pending in the Court of learned S.D.J.M., Jeypore, Dist-Koraput for offences punishable under sections 399/402 of the Indian Penal Code read with sections 25 and 27 of the Arms Act.

The petitioner moved an application for bail before the Court of learned S.D.J.M., Jeypore which was rejected on 10.01.2019.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 09.01.2019 and in the meantime, the investigation has made substantial progress and after going through the statements of the witnesses placed by the learned counsel for the petitioner and taking into account release of the co-accused on bail by this Court in BLAPL No.2504 of 2019 vide order dated 08.04.2019, copy of which is filed and taken on record and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court

in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
