This is an application under section 439 Cr.P.C. in connection with G.R. Case No.795 of 2018 arising out of Jhirpani P.S. Case No.96 of 2018 pending in the Court of learned J.M.F.C., Rural, Rourkela for offences punishable under sections 457/380 of the Indian Penal Code.
The petitioner moved an application for bail before the Court of learned Addl. Sessions Judge, Rourkela which was rejected on 26.04.2019.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 20.03.2019 and investigation has made substantial progress and the offences are triable by Magistrate and the stolen articles have already been seized and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two solvent sureties for the like amount to the satisfaction of the learned Court in session over the matter with further terms and conditions as the learned Court may deem just and proper.
Accordingly, the BLAPL is disposed of.
