01.05.2019 Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 Cr.P.C. for grant of bail to the petitioner in connection with Badambadi P.S. Case No.80 of 2019 corresponding to G.R. Case No. 670 of 2019 pending in the Court of learned S.D.J.M.(S), Cuttack for offences punishable under sections 406/420/34 of the Indian Penal Code.

The petitioner moved an application for bail before the learned 1^st Addl. Sessions Judge, Cuttack which was rejected on 16.04.2019.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 04.04.2019 and in the meantime, the investigation has made substantial progress and the fact that the offences are triable by Magistrate and the cars have already been seized from the possession of the petitioner and on hearing the learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper with further condition that he shall cooperate with the investigation and appear before the

investigating officer as an when necessary and violation of any terms and conditions shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
