13.05.2019 Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 Cr.P.C. in connection with G.R. Case No.99 of 2019 arising out of Chandabali P.S. Case No.53 of 2019 pending in the Court of learned J.M.F.C., Chandabali for offences punishable under sections 498-A/294/323/324/354/307/506/34 of the Indian Penal Code read with section 4 of the D.P. Act.

The petitioner moved an application for bail before the Court of learned Sessions Judge, Bhadrak which was rejected on 24.04.2019.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 05.03.2019 and the marriage between the petitioner and the victim was a love marriage and there was no demand of dowry and the investigation has made substantial progress and since the case arises out of matrimonial dispute and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two solvent sureties for the like amount to the satisfaction of the learned Court in session over the matter with further terms and conditions as the learned Court may deem just and proper.

Accordingly, the BLAPL is disposed of.
