Block, the candidature of the petitioner was rejected as his +2 pass mark sheet and certificate was not available with the application. The panel list of Jhar Gram Panchayat was sent to the Jhar Gram Panchayat through B.D.O., Sohela for compliance in giving appointment order by Sarapanch of the Jhar Gram Panchayat from the merit list. Accordingly the topper of panel list has joined. The topper of G.R.S. panel list later on resigned. Then the 2nd man in the merit list was offered appointment order, he also resigned after joining as G.R.S. It is in the natural course of action, the third man in the merit list should be noticed by Sarapanch, Jhar Gram Panchayat to join as G.R.S. The claim of the petitioner, who has not been selected as G.R.S. due to non-availability of +2 marks sheet cannot be allowed to be placed in the merit list after preparation of G.R.S. panel list and implementation of the list at the belated stage. Thereby, the case of Sri Saroj Kumar Seth, who was 3rd in the merit list, in whose favour engagement order was issued. In that view of the matter, no illegality or irregularity has been committed by the authority concerned. Therefore, this Court does not find any merit in the writ application, accordingly, the writ application stands dismissed.
