The petitioner being in custody in Khaira P.S. Case No. 67 of 2018 corresponding to C.T. Case No. 265 of 2018 on the file of learned J.M.F.C., Soro for alleged commission of offence under section 417/418/420 /376/506/34 of IPC, has filed this application under section 439 of the Cr.P.C. for his release on bail.
Heard learned counsel for the petitioner and learned counsel for the State.
Considering the submissions made and on going through the materials on record including the statement of the victim recorded under section 164 Cr.P.C. and keeping in view the surrounding circumstances as well as the period of detention of the petitioner in custody, in the absence of any other impediment, it is directed that the petitioner be released on bail in the aforesaid said case with such terms and conditions as would be deemed just and proper by the trial court; with further condition that he shall appear in person on each date of posting of the case before the trial court without fail.
The BLAPL is accordingly disposed of. Issue urgent certified copy as per rules.
