The petitioners having been implicated in Mahulpali P.S. Case No.0080 of 2018 corresponding to G.R. Case No.396 of 2018 registered for alleged commission of offence under sections 354/506 IPC pending in the court of learned S.D.J.M., Kuchinda have filed this application under Section 438 of the Cr.P.C. for grant of anticipatory bail.
Learned counsel for the petitioners submits that here in this case the allegation in respect of alleged commission of offence under section 354 IPC is running against accused Ramakanta Rout, the English teacher of the School and the role assigned to these petitioners which much after the said incident. He further submits that these petitioners being under the subordinate to the principal accused had at that time brought to the notice of other teachers.
Learned counsel for the State opposes the move.
Considering the submission, viewing the nature of accusations and other surrounding circumstances of the case, in the absence of any other impediment, it is directed that in the event the petitioners surrender before the court in seisin of the case within a period of fifteen days hence, they shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.
