22.06.2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in G.R. Case No.748 of 2018 on the file of learned J.M.F.C.(R), Cuttack registered under Sections 465/468/471/419/506/420, I.P.C.

It is alleged that the petitioner took some money from the informant for arranging B.Ed. course in Gulbaraga University, Karnataka. The informant had also appeared for the said examination. Despite lapse of time, she was not provided any certificate and a duplicate certificate was provided to her by the petitioner, which was found out to be fake one.

It is submitted on behalf of the petitioner that admittedly, the informant appeared at the examination in Karnataka and hence, there was no cheating. The certificate was to be issued by the concerned University and that there is observation in the rejection order passed by the learned Sessions Judge, Cuttack that there is no allegation that the university did not exist.

It is submitted on behalf of the State that there is allegation of similar cheating by the petitioner to other persons.

It is also submitted on behalf of the petitioner that the petitioner is in custody since 03.05.2018 and he is a

permanent resident of his given address. Some documents are placed in support of the contentions.

Considering the submissions and the circumstances, it is directed that let the petitioner be released on bail by furnishing bond of Rs.25,000/-(rupees twenty-five thousand) with two sureties for the like amount to the satisfaction of the learned J.M.F.C.(R), Cuttack in the aforesaid case with the conditions that:-

I. The petitioner shall not tamper with the prosecution evidence in any manner whatsoever;

II. he shall appear before the Investigating Officer as and when required for the purpose of investigation; and

III. he shall not leave the State of Odisha without prior permission of the learned trial court.

The Bail Application is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
