The petitioner is an accused in G.R. Case No.757 of 2017 on the file of learned S.D.J.M., Bhanjanagar registered under Sections 332/307/34, I.P.C. read with Sections 25(1)(B)(a)/27 of the Arms Act.

It is alleged that while the petitioner along with another was coming on a motorcycle, they were asked to stop by the police but they turned around trying to flee away and the other co-accused allegedly threw two bombs at the police personnel as a result of which the police personnel sustained some injuries.

It is submitted on behalf of the petitioner that the bail application of the petitioner has been rejected by the learned court below with the observation that the petitioner has series of criminal antecedents.

Placing the copies of the orders, it is submitted on behalf of the petitioner that in the cases involving the offence under Section 302, I.P.C., the petitioner has already been acquitted and some other cases have been dropped.

It is further submitted that due to political rivalry, the petitioner has been implicated in this case and is in custody since 10.12.2017. Final charge-sheet has already been submitted in this case.

Considering the submissions and the materials placed before the Court, it is directed that let the petitioner be released on bail by furnishing bond of Rs.25,000/(rupees twenty-five thousand) with two sureties for the like amount to the satisfaction of the learned S.D.J.M., Bhanjanagar in the aforesaid case with the conditions that he shall not involve himself in any criminal activity, shall not tamper with the prosecution evidence in any manner whatsoever and shall not default in personal attendance of the court during trial on each date.

The Bail Application is accordingly disposed of.
