04.12.2017 Heard learned counsel for the petitioner and learned Addl. Government
Advocate.
The limited grievance of the petitioner is that the application for mutation,
bearing Mutation Case No.39/2012 pending before the sole opposite party-Tahasildar, Mahakalapa
da is not being disposed of.
In that view of the matter, the writ petition is disposed of directing the Tah
asildar, Mahakalapada to take up the aforesaid mutation case, as expeditiously as possible, an
d dispose of the same, after affording reasonable opportunity of hearing to all parties concer
ned, within a period of three months from the date of receipt of certified copy of this order,
by reasoned order, if there is no other legal impediment. The authority shall act upon produc
tion of certified copy of this order.
Urgent certified copy of this order be granted as per rules.
Misc. Case No.21014 of 2016 Issue notice as above. Accept one set of process fee.
In the interim, it is directed that the further proceeding in Execution Case N
o.229/2015 passed by the learned District Judge, Cuttack shall remain stayed till the next dat
e.
