This is an application for modification of the order dated 04.12.2017 in WP(C) No.2101
3 of 2017. The writ application has been disposed of giving a direction at paragraph-4, which
is quoted below:
In that view of the matter, this Court disposes of the writ petition directing the Collector,
Jajpur, opposite party no.2, to take appropriate steps for measurement of the exact areas of t
he petitioners encroached for construction of the road and appropriate steps be also taken for
acquisition of the land in a time bound programme. The entire exercise should be completed wi
thin a period of six months from the date of production of certified copy of this order along
with copy of the brief.
At present, the petitioners are aggrieved because no direction has been given by the C
ourt regarding the compensation that they are entitled to for the demolished portion of the ho
use. Hence, it is further ordered that while carrying out the order passed by this Court on 04
.12.2017 in WP(C) No.21013 of 2017, the opposite party no.2 shall also take steps for measurem
ent of the exact demolished portion of the house of the petitioners, if any, and calculate the
compensation. This order shall be read as a part of the order dated 04.12.2017 passed in the
aforesaid writ petition.
The Misc. Case is disposed of.
