2. The petitioner was working as a Data Entry Operator in the Lakhanpur Block in the district
of Jharsuguda as an outsource employee. It is alleged that he was involved in a criminal case
for the alleged commission of offences under Sections 341/294/353/506 of the I.P.C. in G.R. Ca
se No.73/2016. It is borne out from the record that the offences committed by the petitioner a
re not very serious. There is no allegation that the petitioner involves in offences like mora
l turpitude or misappropriation of property. However, registration of the F.I.R., the I.I.C.,
Lakhanpur wrote a letter to the District Welfare Officer, Jharsuguda about the involvement of
the petitioner in this case. The District Welfare Officer, Jharsuguda intimated the Proprietor
, Group-5 Security Service Bhubaneswar that the present petitioner has been arrested and a cas
e has been registered against him for the alleged commission of offences under Sections 341/29
4/353/506 of the I.P.C. and, therefore, Group-5, Security Service, Bhubaneswar was requested t
o disengage the petitioner. Thereafter a letter has been issued by the Managing Partner, Gr
oup-5, Security Service, Bhubaneswar, to the Block Development Officer, Lakhanpur, opposite pa
rty no.3, and opposite party no.3 by virtue of the order dated 24.9.2016, under Annexure-7, di
sengaged the petitioner from his duty from Panchayat Samiti Office, Lakhanpur w.e.f. 9.9.2016.
