 01.03.2017Heard learned counsel for the petitioner, learned Addl. Government Advocate
and Mr. Partha Sarathi Das, learned counsel for the informant.
 The petitioner is apprehending arrest for the alleged commission of offences under Sec
tion 457, 509 and 354 of the I.P.C. in G.R. Case No.230 of 2016 of the court of S.D.J.M., Kama
khyanagar, arising out of Kamakhyanagar P.S. Case No. 148 of 2016.

 Mr. Partha Sarathi Das, learned counsel appearing for the informant, files an affidavi
t sworn by the victim girl, wherein she has stated that she has lodged the complaint against t
he petitioner due to misunderstanding and now there is a settlement between the parties and sh
e does not want to pursue the criminal case against the present petitioner.
 Keeping in view the aforesaid consideration, fact of the case and the fact that the pe
titioner is a permanent resident of Village-Muktapasi, P.S. Kamakhyanagar, Dist. Dhenkanal and
 there is no chance of his absconding from justice and that there is no allegation that the pe
titioner will tamper with the prosecution evidence, if he is released on bail, the application
 for anticipatory bail is allowed. It is directed that on the event of arrest, the petitioner
shall be released on bail on such terms and conditions as deemed just and proper by the Arrest
ing Officer.

 The ABLAPL is accordingly disposed of.
 Urgent certified copy of this order be granted on proper application.
